Agreement to Terms

By accessing our website or using our HVAC services, you agree to be bound by these Terms of Service and all applicable laws and regulations. If you do not agree with any of these terms, you are prohibited from using our services.

Services Provided

Ball Air Conditioning provides heating, ventilation, and air conditioning (HVAC) services including but not limited to:

  • Air conditioning installation, repair, and maintenance
  • Heating system installation, repair, and maintenance
  • HVAC system installation and replacement
  • Air duct cleaning and sanitization
  • Emergency repair services
  • Preventive maintenance programs

Service Agreements and Quotes

Estimates and Quotes

All estimates and quotes provided are valid for 30 days from the date of issue unless otherwise specified. Final pricing may vary based on actual conditions discovered during service.

Service Appointments

Service appointments are scheduled based on availability. We make every effort to arrive within the scheduled time window. Delays may occur due to emergency service calls or unforeseen circumstances.

Cancellation Policy

Customers must provide at least 24 hours notice to cancel or reschedule appointments. Late cancellations or no-shows may be subject to a cancellation fee.

Payment Terms

Payment Methods

We accept cash, checks, and major credit cards. Payment is due upon completion of service unless other arrangements have been made in writing.

Financing

Financing options may be available for qualifying installations and major repairs. Terms and conditions are provided by third-party financing companies.

Late Payments

Accounts not paid within 30 days of service completion may be subject to a late payment fee of 1.5% per month or the maximum rate allowed by law.

Warranties and Guarantees

Service Warranty

We guarantee our workmanship for a period of one year from the date of service. This warranty covers defects in our installation or repair work but does not cover:

  • Normal wear and tear
  • Damage caused by improper use or maintenance
  • Damage from external factors (weather, power surges, etc.)
  • Parts covered by manufacturer warranties
  • Services provided by unauthorized third parties

Manufacturer Warranties

Equipment and parts are covered by manufacturer warranties. We will assist in warranty claims but are not responsible for manufacturer warranty coverage or denials.

Warranty Limitations

Our warranty is limited to repair or replacement of defective workmanship. We are not liable for consequential damages, including but not limited to property damage, loss of use, or personal injury.

Customer Responsibilities

Customers are responsible for:

  • Providing accurate information about HVAC systems and property
  • Ensuring safe access to work areas
  • Securing pets during service visits
  • Maintaining clear pathways to equipment
  • Following maintenance recommendations
  • Promptly reporting service issues or concerns
  • Ensuring payment for services rendered

Liability and Insurance

Our Liability

Ball Air Conditioning maintains appropriate liability insurance. Our liability is limited to direct damages caused by our negligence during service provision. We are not liable for:

  • Pre-existing conditions or hidden defects
  • Damage from previous improper installations
  • Issues beyond the scope of our services
  • Acts of God or force majeure events
  • Indirect or consequential damages

Maximum Liability

Our maximum liability for any claim shall not exceed the amount paid for the specific service that gave rise to the claim.

Emergency Services

Emergency services are provided on a best-effort basis and may be subject to additional fees. Emergency service availability is not guaranteed during severe weather events or other exceptional circumstances.

Maintenance Plans

Customers enrolled in maintenance plans agree to:

  • Annual or semi-annual service visits as specified
  • Automatic renewal unless cancelled in writing
  • 30-day notice required for plan cancellation
  • Priority scheduling for plan members
  • Discounted rates on repairs and parts

Permits and Compliance

We obtain necessary permits for HVAC installations and major modifications. All work is performed in accordance with local building codes and regulations. Customers are responsible for any special permits or homeowner association approvals required.

Property Access

By scheduling service, you grant us permission to access your property for the purpose of providing HVAC services. We respect your property and take reasonable care to minimize disruption.

Intellectual Property

All content on our website, including text, graphics, logos, and images, is the property of Ball Air Conditioning and protected by copyright laws. Unauthorized use is prohibited.

Website Use

Acceptable Use

You agree not to:

  • Use our website for any unlawful purpose
  • Attempt to gain unauthorized access to our systems

Governing Law

These Terms of Service are governed by the laws of the State of Florida without regard to conflict of law provisions. Any legal action must be brought in the courts of Duval County, Florida.

Indemnification

You agree to indemnify and hold Ball Air Conditioning harmless from any claims, damages, or expenses arising from your use of our services or violation of these terms.

Severability

If any provision of these Terms of Service is found to be unenforceable, the remaining provisions shall remain in full force and effect.

Changes to Terms

We reserve the right to modify these Terms of Service at any time. Changes will be effective immediately upon posting. Your continued use of our services constitutes acceptance of modified terms.
